Terms and Conditions of Sale
1. Acceptance
By purchasing products from Skinned Knuckles ("we", "our", "us"), the customer ("you") acknowledges that they have read, understood and agreed to these Terms and Conditions.
2. Nature of Products
Our products are custom-manufactured automotive components intended for use by experienced persons familiar with vehicle modifications.
Many products are intended for off-road, motorsport or competition use unless expressly stated otherwise.
It is your responsibility to ensure that any product purchased is suitable for your intended application.
3. Professional Installation
Unless otherwise stated, all products should be installed by a qualified automotive technician or licensed tradesperson experienced in vehicle fabrication and modification.
We are not responsible for any loss, damage or injury arising from incorrect installation, modification, misuse, abuse or improper maintenance of our products.
4. Vehicle Compliance
You are solely responsible for ensuring that your vehicle complies with all applicable Australian laws, regulations, engineering requirements, registration requirements and roadworthiness standards after installation of any product supplied by us.
We make no representation that any product is legal for use on public roads in your jurisdiction.
5. Inspection and Maintenance
The customer must regularly inspect all fabricated components and associated hardware for wear, fatigue, corrosion, damage or loosening.
Products used in high-performance, off-road, towing or racing applications require frequent inspection and maintenance.
Failure to properly inspect and maintain components may result in failure of the product.
6. Intended Use
Products must only be used for their intended purpose.
Any welding, drilling, machining, modification or alteration of our products after purchase voids any warranty and releases us from liability to the fullest extent permitted by law.
7. Assumption of Risk
Vehicle modification carries inherent risks.
By purchasing and using our products, you acknowledge and accept these risks, including the possibility of property damage, mechanical failure, serious injury or death arising from the operation of modified vehicles.
8. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising from the supply of our products is limited to:
replacement of the product;
repair of the product; or
refund of the purchase price,
at our discretion.
We are not liable for indirect, consequential, incidental, special or economic loss, including but not limited to loss of profits, loss of vehicle use, towing costs, accommodation expenses or business interruption.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or any other applicable legislation.
9. Product Warranty
Our workmanship warranty applies only to defects in manufacturing and does not cover damage caused by:
incorrect installation;
misuse;
accidents;
racing or competition use;
overloading;
corrosion;
lack of maintenance;
normal wear and tear;
modification of the product after supply.
Warranty claims may require inspection of the product before any remedy is provided.
10. Customer Responsibility
The customer is responsible for:
ensuring correct fitment before use;
using appropriate fasteners and torque specifications;
verifying compatibility with their vehicle;
obtaining any engineering certification required by law;
maintaining the product throughout its service life.
11. Indemnity
To the fullest extent permitted by law, the customer agrees to indemnify and hold harmless Skinned Knuckles, its directors, employees and contractors against claims arising from:
improper installation;
misuse of the product;
unauthorised modification;
failure to inspect or maintain the product;
use contrary to applicable laws or manufacturer recommendations.
This clause does not apply to the extent liability cannot legally be excluded.
12. Australian Consumer Law
Nothing in these Terms excludes, limits or modifies any consumer guarantees or statutory rights under the Australian Consumer Law where such rights cannot legally be excluded.
13. Governing Law
These Terms are governed by the laws of the State or Territory in which Skinned Knuckles operates and the laws of the Commonwealth of Australia.
